Definitions of terms :

Please note that the definitions below are short explanations only and are not extensive.

Seller: The seller is the party offering the goods or services, which www.asian-grocery.nl is an online shopping portal of Asian Food Store-Toko is registered as a sole business in the Chamber of Commerce in Amsterdam, The Netherlands.

Seller is interchangeably referred to as we, us, Asian Food Store-Toko and www.asian-grocery.nl

Customer: The customer is an individual, buying the goods and services offered by the seller against an agreed payment. Customer is interchangeably referred to as you, your.

Website: www.asian-grocery.nl & www.asiangrocery.nl the web pages directly linked to it, are interchangeably used for the website in the conditions below.

Contract: The contract is an agreement between seller and buyer, where the seller shall deliver the purchased goods to the customer after the associated payment is approved, and after the buyer agrees to the terms and conditions presented during the checkout process, which are also shown below.

Terms and Conditions:

1. Age and Identification Requirements - Customers must be at least 18 years old to purchase from www.asian-grocery.nl. An active email address and telephone number are required for communication purposes. If requested, the customer agrees to provide a valid government-issued identification to verify the ownership of the credit card or iDEAL account used for the purchase.

 

2. Account Security - The customer is responsible for maintaining the confidentiality of their account details, including the password, and for preventing unauthorized access. The customer accepts full responsibility for all activities conducted using their account. The customer must take all necessary steps to secure their account credentials and must immediately notify us if there is any suspicion of unauthorized use or manipulation of their user ID or password.

 

3. Accuracy of Billing and Delivery Information - The customer is solely responsible for providing accurate billing and delivery addresses. We assume no liability for errors or omissions in these details.

 

4. Delivery Conditions - Delivery will be made to the address specified by the customer during the ordering process. The delivery address must be within the Netherlands. In the event of an incorrect address provided by the customer, only one complimentary local redelivery will be made; further redeliveries may incur additional charges.

 

5. Formation of a Binding Contract - When a customer places an order on www.asiangrocery.nl, the order constitutes a non-binding offer. A binding contract is formed only after full payment has been authorized by the payment gateway and the goods have been dispatched from our shop. No order will be dispatched until the full billed amount has been successfully authorized.

 

6. Order Confirmation and Binding Products - The email confirmation acknowledges receipt of your order only. Only the products listed in the subsequent dispatch confirmation email are included in the binding contract.

 

7. Order Cancellation and Returns - Orders may be canceled in writing prior to dispatch. Once goods have been dispatched, returns are accepted under the following conditions:

• Food Products: May be returned within 7 days of purchase.
• Non-Food Products: May be returned within 14 days of delivery (excluding the day of delivery).
  

Please Note:

The customer is responsible for any return shipping fees, as well as any applicable administrative or cancellation charges. These fees will be deducted from any refund amount.

 

8. Perishable Items - Perishable items are excluded from return.

 

9. Written Communication for Changes or Cancellations - Only written communication (e.g., email) will be accepted for any changes or cancellations of orders, whether before or after dispatch. Cancellation may incur a cash refund fee, as applicable.

 

10. Product Availability - All goods, items, or offers displayed on our website are subject to availability. If an item is temporarily unavailable, we will notify you via email with an estimated availability date. We reserve the right to discontinue any item at any time; our liability in such cases is limited to refunding any amount paid for items we are unable to supply.

 

11. Delivery Time Estimates - We will use our best efforts to deliver your order by the delivery date specified in your dispatch confirmation email. However, this date is only an estimate, and actual delivery may occur later due to factors beyond our control, including delays by the delivery service. We assume no liability for such delays.

 

12. Undelivered or Refused Parcels and Transaction Charges - If a parcel is returned undelivered or is refused at the time of delivery, we reserve the right to charge the full shipping fees for both the return and redelivery, as well as any other applicable fees. Similarly, if you cancel an order, we reserve the right to charge any applicable transaction fees.

 

13. Incomplete Payment - Orders with incomplete or missing payment will be placed on hold. If payment is not received within seven days, the order will be automatically canceled, and cancellation fees may apply.

 

14. Product Quality Disclaimer - We are not responsible for subjective aspects of product quality (such as taste, texture, or color). While we may escalate product-related complaints to the manufacturer, resolution of such complaints remains their responsibility. Product returns will be handled in accordance with clause 7 above.

 

15. Transfer of Ownership and Risk - Ownership and risk for the goods transfer to the customer upon delivery.

 

16. Right to Adjust Prices and Offers - We reserve the right to adjust prices, products, and special offers at any time without prior notice.

 

17. Modification or Discontinuance of Products - We reserve the right to modify or discontinue any or all products at any time, with or without notice. We bear no liability for any modification, suspension, or discontinuation of products or services.

 

18. Deals, Gift Coupons, and Vouchers - Deals, gift coupons, and vouchers are non-combinable and may not be exchanged for cash. We reserve the right to discontinue offers and deals without prior notice. Discounts cannot be combined, and products sold at a discount may not qualify for free shipping.

 

19. Product Images - Please note that all pictures and images on www.asian-grocery.nl are for illustrative purposes only. The actual product may differ slightly from the images displayed.

 

20. VAT Inclusion - All prices include VAT at the applicable rate (9% or 21%), unless otherwise stated.

 

21. Right to Refuse an Order - We reserve the right to refuse to fulfill any order. If an order is refused, you will be notified via email.

 

22. Limitation of Liability and Website Reproduction - No portion of this website may be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial or non-commercial purpose without our prior written consent.

 

23. Use of Trademarks and Proprietary Information - You may not enclose or use any trademark, logo, or other proprietary information (including images, text, page layout, or form) of www.asian-grocery.nl or its affiliates within a frame or by any other means without our written consent.

 

24. Ownership of Brand Images and Trademarks - All brand images and trademarks are the property of their respective owners.

 

25. Meta Tags and Hidden Text - You may not use any meta tags or hidden text containing www.asian-grocery.nl’s or its affiliates’ names or trademarks without our prior written consent.

 

27. Governing Law and Jurisdiction - These terms and conditions shall be governed by and construed in accordance with Dutch law. Any dispute arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the Dutch courts.

 

These terms and conditions have been effective since March 2018.
